Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business, or profession.)

Right of Withdrawal

You have the right to withdraw from this contract within three months without giving any reason.

The withdrawal period is three months from the day

• on which you or a third party named by you, who is not the carrier, took possession of the goods, if you ordered one or more goods in a single order and they are delivered together; or

• on which you or a third party named by you, who is not the carrier, took possession of the last goods, if you ordered multiple goods in a single order and they are delivered separately.

To exercise your right of withdrawal, you must inform us (Sessorium-Commerce GbR, Hauptstraße 36, 74865 Neckarzimmern, Germany, Tel.: +49 151 51751150, E-Mail: support@engel-kette.de) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from choosing a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment for this repayment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must return or hand over the goods to us at Alte Neckarelzer Str. 24, 74821 Mosbach, Germany, without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days expires.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusions and Termination of the Right of Withdrawal

The right of withdrawal does not exist for contracts:

• for the supply of goods that are not prefabricated and for which a personal choice or decision by the consumer is decisive, or which are clearly tailored to personal needs;

• for the supply of goods that are liable to deteriorate quickly or whose expiration date would be quickly exceeded;

• for the supply of alcoholic beverages whose price was agreed upon at the time of the contract, but which can only be delivered after 30 days, and whose current value depends on market fluctuations beyond the entrepreneur’s control;

• for the supply of newspapers, periodicals, or magazines, except for subscription contracts.

The right of withdrawal expires prematurely for contracts:

• for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;

• for the supply of goods that are inseparably mixed with other items after delivery;

• for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
